Privacy statement

This is the Privacy Statement of AquaBattery B.V. (and all of its subsidiaries, hereinafter referred to as AQUABATTERY, “we” “us” or “our”), a company having its address at Eikenlaan 255C, 2404BP, Alphen aan den Rijn, The Netherlands, and registered with the Chamber of Commerce under the number 60486015. 

This Privacy Statement explains how Personally Identifiable Information (“Information”) is collected, used, shared and protected. This Information is collected (the “Services”) when you: 

  • Visit our website with your computer, tablet mobile or other device; or 
  • Use an information request form on our website; or 
  • Provide your information as part of an application process on our website; or
  • Enter into a legally binding contract or agreement with AQUABATTERY; or
  • Engage with AQUABATTERY through other means, not limited to phone or e-mail correspondence. 

All Information is processed in accordance with the General Data Protection Regulation (the “GDPR”), the GDPR-based legislation, European Privacy Laws and other current privacy legislation.

In addition to the above, statistical data are collected whenever you visit our website. These data do not contain any personal identifiable information and cannot be connected to individual person(s). The data as collected from a website visitor are for example: 

  • Country from which the website is visited (but not the IP-address); 
  • The pages that were visited and the duration thereof;
  • Browser type;
  • Operating system;
  • Type of device (like computer, tablet, mobile);
  • Number of returning visits. 

For what purpose do we process Information?

AQUABATTERY collects and processes Information to help us provide and support our Services, including:

  • to reach out to you to engage regarding our products and services;
  • to deliver goods and services to you;
  • to handle your payment;
  • to provide, improve, test, and monitor the effectiveness of our Services;
  • to diagnose or fix technology problems; 
  • to develop and test new products and features; and 
  • to comply with our legal obligations.  

How is the collected Information shared?

AQUABATTERY does not sell your Information to third parties and only provides them if necessary for the execution of our agreement with you or to meet a legal obligation. With companies that process your data on our behalf, we conclude a processor agreement to ensure the same level of security and confidentiality of your data. AQUABATTERY remains responsible for this processing.

If we sell or otherwise transfer part of the whole of AQUABATTERY or our assets to another organization), Information collected through the Services may be among the items sold or transferred. The buyer or transferee will be obliged to honour the commitments we have made in this Privacy Statement. 

Automated decision-making

AQUABATTERY does not make any decisions based on automated processes about matters that can have significant consequences for individuals. 

How long we keep personal data

AQUABATTERY will keep your Information no longer than strictly necessary to fulfil the purposes for which they are collected. 

Legal requests and preventing harm

We may access, preserve and share your Information in response to a legal request if we have a good faith belief that the law requires us to do so. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed, and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm. 

How we protect personal data

AQUABATTERY takes the protection of your Information seriously and takes appropriate measures to prevent abuse, loss, unauthorised access, unwanted disclosure and unauthorised changes. However, AQUABATTERY cannot ensure the security of any Information you transmit to AQUABATTERY or guarantee that Information on the Services may not be accessed, disclosed, altered or destroyed. 

Data residency and sovereignty

If you are located outside of the EU and choose to provide Information to us, please note that we transfer the data to EU, and is thus subject to the GDPR and European Privacy Laws. Your consent to this Privacy Statement followed by your submission of such information represents your agreement to that transfer. 

Viewing, adjusting or deleting data 

You have the right to see, correct or remove your Information. Furthermore, you have the right to withdraw your possible consent for data processing or to object to the processing of your personal data by AQUABATTERY and you have the right to data portability. This means that you can request us to send the personal data we have about you in a computer file to you or another organisation named by you. You can send a request for inspection, correction, deletion, data transfer of your personal data or a request to withdraw your permission or to object to the processing of your personal data to info@aquabattery.nl. To make sure that the request for inspection was made by you, we ask you to send a copy of your proof of identity along with the request. In this copy, please make your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN) are black/unreadable. This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.

Third-party applications, websites and services

AQUABATTERY is not responsible for the practices employed by any applications, websites or services linked to or from our Service, including the information or content contained within them. Please remember that when you use a link to go from our Service to another application, website or service, our Privacy Statement does not apply to those third-party applications, websites or services. Your browsing and interaction on any third-party application, website or service, including those that have a link on our Services, are subject to that third-party’s own policies. 

Changes to this Privacy Statement

We may modify or update our Privacy Statement from time to time. We will notify you of any changes by posting the new Privacy Statement on our website. You are advised to review this Privacy Statement regularly for any changes. Changes to this Privacy Statement are effective when they are posted on this page.
